M3 Academic Journal Blog / Tribal Consultation

The source that I reviewed was within the U.S. General Services Administration and is in regards to tribal consultation. It was created by former president George W. Bush by issuing “Executive Memorandum Government to Government Relationship with Tribal Governments recommitting the federal government to work with federally recognized Native American tribal governments on a government to government basis and strongly supporting and respecting tribal sovereignty and self-determination”. The perspective that it is meant to convey is to inform its readers that the federal government respects tribal sovereignty and an executive memorandum and executive orders exist to support this.
I believe this web resource was selected and put into this course to inform its participants that an actual memorandum was created by the federal government respecting the sovereignty of federally recognized tribes. I also believe this resource was selected to inform its readers that the U.S. has a unique legal and political relationship with various tribes as provided in the Constitution of the United States, treaties, and federal statues mandating that federal consultation with Native American tribes be meaningful, in good faith, and on a government to government level. I believe that the resource I reviewed is of quality due to it being a U.S federal website and elaborating on not only their support for tribal sovereignty, but also breaking down what the executive orders mandate such as to accommodate access to and ceremonial use of Native American sacred sites by Native American religious practitioners and avoiding adversely affecting the physical integrity of those sites.
It further elaborates on the return of certain Native American cultural items, human remains, funerary objects, sacred objects, objects of cultural patrimony, authorization from tribal authorities before permitting archeological excavations on tribal lands, the right and protection of Native Americans to believe, express, and exercise the traditional religions of indigenous America, and protecting and preserving access to sacred sites. The information that I reviewed has not changed the way I view Native communities. On the contrary, the laws that were enacted should’ve been in place a long time ago and the native communities deserve much more than restitution compared to the damage and suffering they endured these past years.

  1. Very interesting post, the Department of Justice has been a part of an annual Tribal Consultation. This is part of the directive ordered under George Bush (Department of Justice (DOJ). Three of the goals of this consultation is to administer tribal funds and programs, enhance the safety of Indian women from violent crime, and improving the federal response to these crimes (DOJ). I think this policy of Tribal Consultation is a good thing, that is designed to improve relations with the Native Americans. I think this program can help prevent future mistreatment of the Indians from the government. While this won’t fix all of the mistakes of the past, but it is a good step forward.
